Community4Celiac, LLC and Driftwood Day Camp have made every effort to ensure your safety and comfort while attending and/or participating in the Family Fun Day. However, it is important that you understand the inherent risks associated with this event. Therefore, in consideration for being allowed to register for, participate in, present at the Community4Celiac Family Fun Day at Driftwood Day Camp (the “Event”), you hereby waive, release from liability, assume all risks, and covenant not to sue Community4Celiac, LLC or Driftwood Day Camp, or each of their respective members, shareholders, directors, employees, agents, representatives, or volunteers (each, the “Host”) for any expense, loss, damage, personal injury (including loss of life, disability, or serious harm), property damage or theft, negligence, or actions (each, a “Loss”) resulting from or arising in connection with your attendance at, or participation in the Event. You agree that this waiver and release binds you and your agents, assigns, representatives, and shall be enforceable to the fullest and broadest extent of the law, and, if any portion is held invalid, the remainder should continue in full legal force and effect. You are an adult of sound mind and capable of reading and understanding this waiver and release. You have read its terms and fully understand and agree to the provisions herein.
You understand and are aware that your attendance at and/or your participation in the Event involves risk, including, but not limited to, ingesting various foods, travel, physical activity, locales where public health and safety may be at risk, or activities that involve risk that you create for others or others may create for you. These risks may lead to a Loss, and you nonetheless choose to attend and/or participate in the Event. You are also aware that there are risks that you may not have considered, yet you waive your right to any claims that may occur from these unconsidered risks and you choose to participate in the Event. You acknowledge that no promises, representations, or affirmations of fact were made to you by the Host or their representatives concerning the safety or danger associated with traveling to the Event or participating in any activity or interaction related to or associated with the Event.
You agree to indemnify and hold harmless the Host from any loss, liability, damages or costs Host may incur, whether caused by negligence, active or passive, or otherwise, in connection with your participating in the Event. This waiver and release shall be governed by and construed in accordance with the laws of the State of New York and enforced only in the courts of same. The courts sitting in Nassau County New York shall retain the exclusive jurisdiction over any disputes arising under or related to this Waiver and Release of Claims, and you expressly consent to the personal jurisdiction of same.”
